Summary: Use AITaana responsibly, keep your API keys secure, and don’t use the Service for unlawful or abusive activities. The Service is provided “as is”; AI outputs may be inaccurate; and our liability is limited as described below.
1. Acceptance
By accessing or using AITaana, you agree to these Terms. If you don’t agree, do not use the service.
2. Who we are (operator)
The Service is operated by Euclidev (“AITaana”, “we”, “us”, “our”), with a registered address at Algiers, Algeria. Contact: support@aitaana.com.
3. Eligibility and accounts
- You must be legally capable of entering into a contract and comply with applicable laws when using the Service.
- You are responsible for activity under your account/workspace, including activity by authorized members and any usage via API keys.
4. Security and API keys
- You are responsible for your account and for keeping credentials and API keys secure.
- Do not share API keys publicly. Rotate keys if exposed or suspected to be exposed.
- You must notify us promptly if you suspect unauthorized access and take reasonable steps to secure your account.
5. Developer API and usage limits
- You may access the API only via your own credentials and in accordance with documentation, rate limits, and plan restrictions.
- We may impose or change rate limits and usage policies to protect the Service, prevent abuse, or comply with law.
- You are responsible for securing your integration and any use of the API through your keys.
6. Acceptable use (prohibited activities)
You agree not to:
- Use the Service for unlawful activity, fraud, phishing, or scams.
- Generate, distribute, or facilitate malware, exploitation, or unauthorized access.
- Attempt to probe, scan, or test the vulnerability of our systems or bypass rate limits.
- Scrape, harvest, or exfiltrate data from the Service without authorization.
- Upload or share content that infringes intellectual property or privacy rights (including doxxing).
- Generate or distribute child sexual abuse material (CSAM) or content that sexualizes minors.
- Use the Service to harass, threaten, or incite violence against individuals or groups.
We may enforce these rules through content removal, rate limiting, API key rotation/revocation, suspension, or termination (see Section 12).
7. Input/Output, content, and IP
“Input” means prompts, messages, files, and other content you submit to the Service. “Output” means the results generated and returned by the Service.
- Your Input: you retain ownership of your Input. You grant us a worldwide, non-exclusive license to host, store, reproduce, and process your Input solely to provide, secure, and maintain the Service and comply with law.
- Your Output: as between you and us, to the extent permitted by law, you own the Output generated for you. Output may be similar or identical for other users.
- Our IP: we retain all rights to the Service, software, models/agents, and documentation, including improvements and derivatives.
- Feedback: if you provide feedback, you grant us the right to use it without restriction or compensation.
8. AI outputs and user responsibility
AI outputs may be inaccurate, incomplete, or misleading. You are responsible for evaluating Output for accuracy and suitability and for obtaining professional advice when appropriate. You must not rely on the Service as a substitute for professional judgment in legal, medical, financial, or safety-critical contexts.
9. Payments, subscriptions, and credits
- Payment processing: payments are processed by third-party payment providers; their terms may apply.
- Taxes: you are responsible for applicable taxes, duties, and similar charges unless stated otherwise.
- Auto-renewal (subscriptions): subscriptions may renew automatically unless you cancel before renewal.
- Credits: credits (if offered) are non-transferable, have no cash value, and are usable only within the Service. Credits do not expire unless stated at purchase or required by law.
- Refunds: credits and subscriptions are non-refundable except where required by law or expressly stated at purchase. Contact support promptly if you believe a billing error occurred.
- Chargebacks: initiating a chargeback without contacting support first may result in suspension pending investigation.
- Price changes: we may change prices or plans. For subscriptions, changes generally take effect on your next renewal after reasonable notice.
10. Privacy and data
Our Privacy Policy describes how we collect, use, and protect personal data. By using the Service, you acknowledge our data practices as described there.
Content use/training: we process Input/Output to provide the Service. We do not use your content to train public models unless you explicitly opt in (if such an option is offered).
11. Disclaimers (no warranties)
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that Output will be accurate or reliable.
12. Suspension and termination
- We may suspend or terminate your access (in whole or in part) immediately if we reasonably believe you violated these Terms, pose a security risk, or if required to comply with law.
- We may remove or restrict access to content, rotate/revoke API keys, or apply rate limits to protect the Service.
- You may stop using the Service at any time. You are responsible for charges incurred prior to cancellation.
13. Limitation of liability
To the maximum extent permitted by law: (a) we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business interruption; and (b) our total liability for all claims arising out of or relating to the Service will not exceed the amounts you paid to us for the Service in the three (3) months preceding the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Indemnity
You will indemnify and hold harmless AITaana and its affiliates, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your Input, your use of the Service, or your violation of these Terms or applicable law.
15. Governing law and disputes
These Terms are governed by the laws of Algeria, without regard to conflict of law rules. Any dispute arising out of or relating to these Terms or the Service will be brought in the competent courts located in Algiers, Algeria, and you consent to their jurisdiction.
Before filing a claim, you agree to contact us and attempt to resolve the dispute informally.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or in-app notice) before the changes take effect. If you do not agree to the updated Terms, you must stop using the Service before the effective date.
17. Miscellaneous
- Third-party services: the Service may integrate with third parties (including payment providers). We are not responsible for third-party services.
- Severability: if any provision is unenforceable, the remaining provisions remain in effect.
- Assignment: you may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or asset sale.
